Terms of Service

These Terms of Service ("Terms") govern your access to and use of Volleymate ("the Service"), operated by Reza Barzegar Gashti, Germany, during a private beta. By creating an account or using the Service, you agree to these Terms.

1. Access, Eligibility & Cost

Volleymate is currently in private beta and is only accessible by invitation or approval. You must be at least 16 years old to use the Service. Access is granted to professional volleyball organizations, coaches, analysts, and players affiliated with teams on the platform.

Signing in alone does not grant team membership or access to a team's match data. Team membership requires an invitation or approval from an authorised team leader or platform administrator. A request can be declined, and a team can block further requests. Your access depends on the team, Edition and role granted; an account awaiting approval has restricted access.

Volleymate is currently provided free of charge. No payment, subscription, or purchase is required or accepted at this time. If this changes in the future, we will update these Terms and notify users before introducing any paid features.

We reserve the right to grant, suspend, or revoke access at any time, including during the beta period.

2. Your Account

You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it. You must sign in using Google or Apple — you are responsible for the security of that account.

You must not share your account with others or use another person's account without permission.

3. Acceptable Use

You agree not to:

• Upload content you do not have the right to share
• Attempt to reverse-engineer, scrape, or circumvent the platform's security
• Use the platform for any unlawful purpose
• Impersonate another person or organization
• Interfere with the platform's normal operation
• Upload malicious files or code

4. Your Content

4.1 You keep your rights. You keep ownership of everything you upload to Volleymate, including scout files (.dvw), match videos, and team data ("Your Content"). We do not become its owner.

4.2 Licence to run the Service. You grant us a non-exclusive licence, for as long as Your Content is on Volleymate, to store, process, analyse and display it as needed to run the Service, including to the people, teams and editions you choose to share it with. You decide who can see it. You can delete it at any time; deleting it ends this licence for that content, and copies in our backups are removed on the normal backup cycle.

4.3 AI features and learning from your uploads. Volleymate's AI features, for example Vision AI, are free because they learn from what you upload. To use them you agree when the app asks you before you start an AI analysis, or you switch on "Help improve Volleymate analysis" in your settings. Agreeing also allows us to use the content you upload after you agree to train and test our own analysis models, for example to find rallies and actions in a video or to predict what happens next. Where possible we train on numbers derived from your content, not on the content itself, and we remove player and team names from scout files before they are used. Everything else in Volleymate works without it. Your private matches, and everything in them (video, scout files and anything derived from them), are never used for this, whatever you choose. We train models for Volleymate only. We do not sell or hand over Your Content, and the models do not reproduce your video. You can switch it off at any time: new AI analyses then stop for you, results already made stay, and from then on your content is left out of every new training run. A model that has already been trained cannot be undone. Without this agreement we do not use Your Content to train models, the AI features stay off for you, and the rest of the Service works as before.

4.4 Your promise about rights. You confirm that you have the right to upload Your Content and to grant the licences above, including the permission of whoever filmed or owns the recording and of the people shown in it. Do not upload a competition recording that its organiser or broadcaster has not allowed. Do not switch on the option in 4.3 if anyone under 18 is shown in what you upload.

4.5 Results and models. Analyses, markers and statistics we create about Your Content are available to you. The models we train are ours.

4.6 Earlier uploads. Content you uploaded before October 15, 2026 stays under the licence that applied when you uploaded it, which covered running the Service for you only. It is never used to train models. This does not cover recordings and scout files that Volleymate itself uploaded or produced: we may use those to train and test our own models.

5. Intellectual Property

The Volleymate platform — including its software, design, analytics algorithms, and branding — is the exclusive property of its operator and is protected by copyright and other intellectual property laws. You may not copy, modify, or redistribute any part of the platform without our written permission.

6. Service Availability

We aim to keep Volleymate available at all times but do not guarantee uninterrupted access. We may perform maintenance, updates, or emergency shutdowns that temporarily affect availability. We are not liable for losses arising from service interruptions.

During the beta period, features may change, be removed, or behave unexpectedly. Beta access is provided "as is."

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE SERVICE — INCLUDING LOSS OF DATA OR PROFITS.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under German law.

9. Indemnification

You agree to indemnify and hold harmless the operator of Volleymate from any claims, damages, losses, or expenses (including reasonable legal fees) arising from: (a) your use of the Service in violation of these Terms; (b) content you upload, including any claim that it infringes or violates the rights of a third party (including a player's data protection rights); or (c) your violation of any applicable law. This does not affect any liability that cannot be limited or excluded under German law.

10. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms or for any other reason, with or without notice. You may stop using the Service at any time.

Upon termination, your right to access the Service ends. We will handle your data as described in our Privacy Policy.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via the platform. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany. Any disputes will be subject to the exclusive jurisdiction of the courts of Germany, unless mandatory consumer protection laws in your country provide otherwise.
